The Supreme Court in J.D. Srivastava v. State Govt. of Madhya Pradesh (AIR1984 (SC)) held that if there is no adverse clause in his/her performance reports for most of the previous 10 years period of 10 years in his/her performance reports, the same shall be a basis for him/her to prove that his/her performance is satisfactory. 630) ordered in the case.
